But to answer your question, yes, more than likely an attorney would help in real life. But you also have to account that this isn't a realistic movie. It's a cartoonish comedy. Plus, Happy is very impulsive in both films. So he ends up penniless after a series of bad financial decisions... plus getting sued. (Although to be fair, it's also not unheard of in real life. Plenty of people with tons of money end up poor after bad financial decisions.)
